Terms of Use

1. What Keel is

Keel is a mobile application designed to support your mental wellbeing through mood tracking, guided exercises, journaling, and AI-powered conversations. It uses evidence-based techniques from Cognitive Behavioural Therapy (CBT), Dialectical Behaviour Therapy (DBT), and Acceptance and Commitment Therapy (ACT).

2. What Keel is not

Keel is not a medical device, diagnostic tool, or substitute for professional mental health care. It does not:

• Provide clinical diagnoses
• Prescribe medication or treatment
• Replace therapy, counselling, or psychiatric care
• Guarantee any health outcomes

If you are experiencing a mental health crisis, please contact your local emergency services or a crisis helpline immediately. Keel provides crisis resources within the app, but it is not an emergency service.

3. Eligibility

You must be at least 16 years old to use Keel, in accordance with GDPR Article 8. By using the app, you confirm that you meet this requirement.

4. Your responsibilities

When using Keel, you agree to:

• Use the app for personal wellness purposes only
• Not rely on Keel as your sole source of mental health support
• Seek professional help when needed, especially for serious or persistent mental health concerns
• Not use the app to harm yourself or others
• Not attempt to reverse-engineer, modify, or misuse the app

5. AI conversations

Keel's AI companion uses a third-party language model (Anthropic's Claude API) to generate responses. While we design the AI to be helpful, supportive, and safe:

• AI responses are generated automatically and may not always be accurate or appropriate
• The AI does not have clinical training and cannot assess your mental state
• You should not treat AI responses as professional advice
• Safety filters are in place to detect and respond to crisis situations, but no system is perfect

6. Your data

Your data is stored locally on your device. Please see our Privacy Policy for full details on how your information is handled, including your rights under the EU General Data Protection Regulation (GDPR).

You are responsible for backing up your data. If you uninstall the app or switch devices without exporting your data, it will be permanently lost.

7. Availability

Keel is provided as-is. We do not guarantee uninterrupted access to the app or its features. The AI conversation feature requires an internet connection and depends on third-party services that may experience downtime.

8. Limitation of liability

To the maximum extent permitted by applicable law, including EU consumer protection regulations, Keel and its creators shall not be liable for:

• Any decisions you make based on information provided by the app
• Any harm arising from reliance on the AI companion's responses
• Loss of data due to device failure, app uninstallation, or software updates
• Any indirect, incidental, or consequential damages arising from your use of the app

Nothing in these terms excludes or limits liability for matters which cannot be excluded under applicable law.

9. Intellectual property

The Keel app, its design, content, and code are owned by Keel. You may not copy, modify, distribute, or create derivative works based on the app without written permission.

10. Changes to these terms

We may update these terms from time to time. The effective date at the top will reflect the most recent revision. Continued use of the app after changes constitutes acceptance of the updated terms.

11. Governing law

These terms are governed by and construed in accordance with the laws of Denmark. Any disputes shall be subject to the jurisdiction of the Danish courts, without prejudice to mandatory consumer protection laws of your country of residence within the EU.
